Our employment practice advises employers and senior individuals across the full range of contentious and non-contentious matters — from executive contracts and incentive arrangements to retrenchments, misconduct investigations and tribunal proceedings. We are recognised by the Legal 500 and IFLR1000 as part of a ranked Singapore practice, and Vincent Tan was named an ALB Rising Star in 2022.

The practice is led by Vincent Tan, Director, whose experience spans contract advisory, executive separations, and retrenchment exercises. He acts for both employers and senior individuals, with particular depth in complex matters where speed and judgment matter as much as technical knowledge.

Our employment work is closely integrated with the firm’s Corporate M&A and Private Wealth practices. We advise on employment due diligence in transactions, share plan treatment on exit, and the personal legal dimensions of executive wealth — giving clients a joined-up view that a standalone employment practice cannot provide.

Our clients range from MNCs and private equity-backed businesses to private banks, family offices and senior executives seeking independent counsel.

We have particular experience in executive exits and senior separations, where employment law, share plan crystallisation, post-termination restrictions and litigation strategy must be held together. These matters require judgment, not process.

  • Contracts: Employment contracts, executive service agreements, equity and bonus arrangements, confidentiality obligations, and workforce policy frameworks
  • Executive Exits: Structuring and negotiating senior separations, severance arrangements, garden leave, long-term incentive treatment, and departure terms at Board and C-suite level — for employers and individuals
  • Restrictive Covenants: Drafting and advising on enforceability of non-compete, non-solicitation, and confidentiality obligations; advising on breach and defending against overreach when employees move to competitors
  • Retrenchment: Advising on workforce reductions and retrenchment exercises in compliance with MOM guidelines, the Tripartite Advisory, and the Employment Act — including communications strategy and regulatory notifications
  • Investigations: Conducting independent workplace investigations into misconduct, harassment, discrimination, and whistleblowing allegations — with findings that withstand scrutiny at tribunal or in litigation
  • Pre-disputes: Advising employers and employees regarding claims before the Employment Claims Tribunal, MOM mediation, and in wrongful dismissal, breach of contract, and salary dispute proceedings
  • Work Pass: Employment Pass applications and renewals, S-Pass matters, and the MOM fair consideration framework — including responses to rejection and MOM inquiries
  • Cross-Border: Secondments, regional mobility frameworks, dual employment arrangements, and tax residency considerations for MNCs deploying talent across Asia

Executive Exit

Advised a multinational corporation on the separation of a regional director, including negotiation of severance terms, treatment of unvested equity, enforcement of post-termination restrictions, and management of a threatened Employment Claims Tribunal filing.

Retrenchment

Advised a Singapore-based subsidiary of a European MNC on a retrenchment exercise affecting multiple employees, including MOM notification, Tripartite Advisory compliance, severance calculation, and employee communications strategy.

Restrictive Covenants

Advised a financial services employer on the enforcement of post-termination non-solicitation obligations against a departing senior employee who had joined a direct competitor and begun approaching clients.

M&A Integration

Conducted employment due diligence as part of a regional private equity acquisition, identifying outstanding tribunal claims, non-compliant employment contracts, and key-person departure risk across the target’s Singapore and regional workforce.

Senior Individual

Acted for a C-suite executive in negotiating departure terms following a change of control, including accelerated vesting of long-term incentive awards, extended garden leave, and removal of disproportionate non-compete restrictions.

Workplace Investigation

Conducted an independent investigation for a Singapore-listed company into allegations of workplace harassment at senior management level, producing findings and recommendations presented to the board’s audit committee.

Criminal proceedings

Advised a leading multinational company on a criminal investigation for insider trading into a senior-level employee, conducted by the Commercial Affairs Department of Singapore in conjunction with the Monetary Authority of Singapore, along with assistance from the Australian Securities and Investments Commission.
